Abstract
The Bhen Ghiben tradition is one of the Madurese wedding customs that is still practiced today, including by the Madurese diaspora in Batu Belaman Village, Kumai District. This tradition involves the groom’s family presenting various household items to the bride as a symbol of their readiness to build a family life together. The existence of the Bhen Ghiben tradition is worth studying because it not only embodies cultural values but also demonstrates the dynamic relationship between customary law and Islamic law in community life. This study aims to analyze the practice of the Bhen Ghiben tradition among the Madurese community in Batu Belaman Village, Kumai Subdistrict, and to identify the factors influencing the relationship between Bhen Ghiben customary law and Islamic law in the marriage ceremony. This study employs an empirical legal research method using qualitative and socio-legal approaches. Data were collected through observation, interviews, and documentation involving traditional leaders, religious leaders, couples practicing the Bhen Ghiben tradition, and the residents of Batu Belaman Village. The collected data were analyzed using qualitative descriptive methods, drawing on the theories of Legal Pluralism and Living Law, as well as the concept of ‘urf in Islamic law. The research findings indicate that the Bhen Ghiben tradition is still practiced as an important part of the traditional wedding customs of the Madurese community in Batu Belaman Village. This tradition is carried out through the gifting of household items, electronic devices, vehicles, and other necessities for the new family from the groom’s family to the bride’s family. The community interprets Bhen Ghiben as a symbol of the prospective husband’s responsibility, a form of respect for the bride’s family, a means of strengthening kinship ties, and an effort to preserve Madurese cultural identity in diaspora communities. Additionally, the study found that the relationship between the customary law of Bhen Ghiben and Islamic law is harmonious and complementary. Factors influencing this relationship include the community’s religious understanding, the roles of religious and traditional leaders, family support, economic conditions, education, and the influence of modernization. These findings demonstrate that the Bhen Ghiben tradition is a tangible manifestation of legal pluralism within the community, where customary law and Islamic law coexist in regulating the social life and marriages of the Madurese community in Batu Belaman Village.
